Disclaimer: This fictitious show cause notice has been drafted for the review and issue by Mrs. Sonia Gandhi, Chairperson, UPA to Mr. Kapil Sibal, Telecom Minister. All content is to be taken with bags of salt and tubs of humour.

Dear Mr. Sibal,
Show cause as to why we, the Indian National Congress shouldn’t expel you for aiding and assisting our arch enemies the Bunch of Jokers Party and their disintegrated NDA and senile A B Vajpayee (ABV) at a time when we asked you to find the culprits of the 2G scam and remedy all defects in policy and execution and therefore in direct defiance of the PM’s orders.
However, since you have done good work as Education Minister, we are prepared to let the matter lie and not press this SCN – provided you withdraw the facts you have placed before the public in your presentation slides but let your allegations, denials and insinuations stand as made in the presser and on CNN-IBN interview, along with a public apology to our honourable, honest, upright, economist, world popular and respected PM Shri Shri Shri Manmohan Singh Ji and the UPA within 30 minutes of release of this SCN from my computer.
Otherwise, the following points will be used by those jokers to further create problems for our shining and united UPA.
A close reading of your infamous PPT* (attached) shows:
1. Time and again, you validate the BJP accusation that auction (or bidding, what’s the difference anyway?) was used since NTP 1994. In fact you do so in your opening slide #4. That slide along with #5 is an advertisement for the BJP, not INC. That’s treason!
a. Therefore, after the teledensity growth had tapered off as per your own figures and fallen in our UPA1 & UPA2, there is no case for not asking for market based prices for spectrum since the promotional policies in the FYP were long expired.
b. Time and again, you show ABV as having taken the lead in policy formation, even making TRAI a powerful body. But during UPA1 & 2, you show UPA as following the orders of the TRAI, revealing a deeply hidden fact that the PM and Cabinet took absolutely no initiative on policy formation.
c. As a matter of fact, you seem hell bent on revealing that our honourable, honest, upright, economist, world popular and respected PM actually has neither brains nor brawn, which is the real reason for his elevation to keep the seat warm for Baba and act as per my remote control. And since I don’t watch those wretched TV channels, I didn’t use the remote either. So his inactivity is a slight on me, as everyone knows I hold the remote control.
d. WHY did you have to highlight that there were no policy reviews and improvement whatsoever in UPA 1&2? By doing this you have actually proved that our honourable, honest, upright, economist, world popular and respected PM is a master of inaction!
2. WHY did you have to include slide #7 where you admit that we… er, Raja didn’t follow the FCFS at all in your conclusion slide #22? That’s where the real scam happened as you know. Now you give THEM a clean chit and frame us!
3. WHY did you have to go and acknowledge that it was ABV who introduced competition by opening up licenses when you well know that that was the ONLY reason why ARPUs fell? And that their X Plan was the real basis and cause for the success of the telecom industry and Aam Admi getting cheap phone calls? Slide #8 Aam Admi belongs to me, not to ABV or BJP. I am their savior!
4. Then in slide #9 you go on to actually praise them for following good policy and procedure! But in your conclusion slide #22 you admit to our not doing so!!!
5. Slide #11 you state we followed TRAI instructions. Are supposed to set policy and they follow it or the other way around?
a. WHY did you say we followed NTP 199 and X Plan when both had expired before we assumed power?
b. Do you mean to insinuate that we had no policy of our own? Even in 2011?
c. This will only fortify their argument that the PM is weak, inactive and unimaginative, let alone spineless.
6. The next slide #12 is the most directly damning evidence they, the BJP, need. The most important admission of wrong doing is that which kicked off the scam itself: the sudden and nearly unpublished changing of the “cutoff date” from 1st Oct 2007 to 25th Sept 2007. By admitting that only applications received up to 25th September 2007 while 1st Oct was the announced date, you have provided the evidence needed to show malafide intentions. WHY did you have to say anything about those dates???
a. They will now use the fact that some Bank DDs were pre-dated for the exact amount, so 30 mins time to comply was used to favour our people.
b. WHY did you have to admit that 343 applications were received within the official cutoff date and only 121+1 were processed? How will you answer the question “what was the tearing hurry for asking for huge DDs in 30 mins?” “What was the tearing hurry to disqualify others?”
c. When you admit there were too many applicants, then how will you answer the question ‘why you didn’t auction spectrum even at that stage’?
d. As if this was not enough, you actually admit that 2 applications (of one applicant!) was processed FOUR months later!!!! How will you justify that? Why didn’t the other rejects also not get a reprieve? You have only succeeded in adding more ammunition against UPA!!!
e. Out of 343 applications, only 122 were awarded spectrum/licenses – but you don’t say why 211 were rejected?
f. If 16+1 applicants got 122 UAS licenses, that means an average of 7 for each. Now they will ask: WHY didn’t you just give 1 license per applicant and cover more of the 343 applicants? WHY have you promoted monopolies in selected 17 applicants?
7. Slide #13 is indeed an unlucky one. Here you admit that we forced TRAI Chairman to say “No auction for 2G” in 2010 when in slide 11 you say TRAI said “In future, all spectrum in 2G should be auctioned” way back in 2007. This will only provide evidence of how we… er… UPA subverts “independent” institutions like TRAI, CBI etc. What have you gained except to show how well the NDA and ABV worked?
8. In slide #16, I admit you make a molehill look like a mountain since you cleverly omitted the one positive factor that matters: That the subscriber base grew 7.75 TIMES between 2004 and 2008 and actually made the value of the spectrum shoot up! Any pin head who sees your own slide #25 can work it out. But that’s comes later…
9. While slide #17 is what I call clever sleight of hand, unless you can also come up with equally clever answers for the following questions I am sure they will raise, even this slide will be held against you in your hearing on the SCN:
a. By your own admission in the whole presentation, there were no “policy has evolved continuously since 1999” as you have sighted none after 2004 in UPA time!
b. There was no increase in teledensity and little improvement in affordability since 2004 when both were at their best when the BJP was in power. The chart below has been made from your own data in slide #25 and it show the truth:
c. Notice also that the TRAI recommendations after Jan 2005 to May 2010 has been nil? That’s just shows the inaction allegation is true. WHY did you have to mention all that in the slide? What advantage did you get for us?
10. Anyone duffer who reads the whole presentation can connect up that the growth in subscribers base between 1999 and 2004 was the best and that between 2008 and 2010 was just 2.43 times while the losses due to non-auction of 2G was NOT responsible for ANY of the benefit of Rs. 1,00,000 Cr. p.a. that you quote. Why did you have to mention it and give the BJP all the credit!?!?
11. Both slides #19 and #20 are hog wash and you know that. So while I will let it go, I reserve the right to use them when I lead evidence against you in the SCN hearing.
a. One question you will need to have a good answer for; When you claim GOI encourages FDI in telecom (slide #20), why did you reject the Tata-SingTel and Airtel-SingTel deal on 24th Jan 2010?
12. Slide #22 was totally unnecessary. All you do there is point out that ALL the benefits arose from BJP policies! Not ONE of our famous and worldwide applauded initiatives were mentioned. Is it because you work for the BJP or is it that we didn’t have any?
a. THERE WAS NO NEED WHATSOVERE TO ADMIT THAT THERE WERE ‘DEFICIENCIES’ IN FOLLOWING PROCEDURES OR EXECUTION. THIS IS AN ADMISSION OF THE VERY GUILT WE ARE CHARGED FOR. WHAT DEFENCE WILL YOU NOW TAKE IN COURT???????????????????
